Partisnewclear takes intellectual property rights seriously and has outlined a procedure for reporting intellectual property infringement. Here’s a summary:

A. Reporting Infringement:

  1. Identify the copyrighted work or intellectual property that has been infringed.
  2. Describe how the material infringes on the identified work and where it’s located.
  3. Provide your contact information.
  4. Confirm that you have a good faith belief that the use is not authorized.
  5. State under penalty of perjury that the information provided is accurate.
  6. Include an electronic or physical signature.

B. Response to Infringement Notification:

  1. Remove or disable access to the infringing content.
  2. Notify the member whose content has been removed.
  3. Terminate access for repeat offenders.

C. Counter-Notice Procedure:

  1. Identify the removed or disabled content.
  2. State that the removal was a mistake or misidentification.
  3. Provide contact information.
  4. Consent to the jurisdiction of the Federal Court.
  5. Include an electronic or physical signature.

If a counter-notice is received and no action is taken by the rights owner, the removed content may be restored in 10 to 14 business days. However, under Section 512(f) of the DMCA, misrepresenting infringement may lead to liability for damages, including attorney’s fees.
